Restraining Order Cases
The Law Offices of Qadeer & Sheikh represent and assist clients with restraining order matters, also referred to as domestic violence.
The standard for entry of a Final Restraining Order (FRO) under the New Jersey Prevention of Domestic Violence has been long established by the Courts. It is discussed in depth in the case Silver vs.Silver. In order to turn a temporary restraining order into a final one, the plaintiff(the alleged victim)must have a qualifying relationship with the defendant, and also has the burden to establish that:
1. The defendant committed one or more of the predicate acts of domestic violence identified in the Prevention of Domestic Violence Act; and
2. There is a need for the protection of an FRO going forward.

Contested vs Uncontested Divorce

Notice of Motion for Support or Other Relief
The Law Offices of Qadeer & Sheikh often assists clients who need to file Notice of Motions, Notice of Cross-Motions or Orders to Show Cause (an emergency motion). Filing a motion means that you are asking the court to order something. It can mean you are requesting a change to something that the court had previously ordered, asking for something new, or even asking for enforcement of an agreement or court order.
It can also be an initial motion for establishing custody for the first time or support for the first time. If you have filed a divorce case, you also have the right to file a motion to get support or parenting time during your divorce case. These are called Pendente Lite motions, which refer to the need to keep the “status quo” (keeping things the same). Annulments
The Law Offices of Qadeer & Sheikh represent and assist clients with annulment matters. Annulments are defined under New Jersey Statutes Annotated 2A:34-1.
An easy way of understanding what an annulment is that it means your marriage should be considered as if it did not happen or should be “erased.” There are various grounds for obtaining an annulment such as already being married or some form of fraud or misrepresentation that existed at the time the parties entered into the marriage.
